'Killer whale' sighted off Norfolk coast at Sheringham

Reports that a killer whale has been sighted off the Norfolk coast have been described as "highly reliable" by an expert on mammals.
County mammal recorder Dr David Leech said claims of a whale sighting by birdwatchers at Sheringham could be the first ever recorded in Norfolk.
The experience of one observer meant there was good cause to believe the sighting was reliable.
Possible reasons for the whale's presence are food or it was off course.
Birdwatcher Giles Dunmore, who has experience spotting several killer whales around the world, recorded the sighting last Thursday morning while scanning for sea birds with friend Phil Vines.
He said the pair's field notes and sketches were currently being collated to pass on to the Norfolk Biological Information Service (NBIS), at County Hall, to confirm the identity of the wandering whale.

Whales not slaves because they are not people, judge in SeaWorld case rules

A US federal judge has thrown out an animal rights group's lawsuit accusing SeaWorld of enslaving captive killer whales, ruling that orcas have no standing to seek the same constitutional rights as people.

People for the Ethical Treatment of Animals (Peta) had accused the chain of aquatic theme parks of violating the rights of whales under the 13th amendment of the US constitution, which abolished slavery.

The lawsuit, filed in the US district court of San Diego, listed as plaintiffs five performing orcas at SeaWorld's parks in California and Florida: Tilikum, Katina, Corky, Kasatka and Ulises.

"The only reasonable interpretation of the 13th amendment's plain language is that it applies to persons and not to non-persons such as orcas," US district judge Jeffrey Miller wrote in his ruling.
"Both historic and contemporary sources reveal that the term 'slavery' and 'involuntary servitude' refer only to persons."

The 13th amendment was enacted in 1865, the year the US civil war ended.

Legal experts previously denounced as frivolous the Peta lawsuit, which had sought a court order requiring SeaWorld to release the five killer whales to a "suitable habitat".
Miller noted in his ruling that animals did have legal rights under state and federal statutes, including criminal laws.
He added the "goal" of Peta attorneys who brought the lawsuit "to protect the welfare of orcas is laudable" even if the 13th Amendment was not the correct way to approach the case.
David Steinberg, a professor at the Thomas Jefferson School of Law in San Diego, told Reuters when the lawsuit was filed in October that it was "demeaning [to] the integrity and humanity of people who were owned as slaves".

Virginia-based Peta has staked out a number of controversial positions in the past in seeking to advance the cause of animal rights.

In 2003 the Anti-Defamation League accused Peta of trivialising the deaths of Jews in the second world war with a campaign that compared the meat industry to the Holocaust.
Colleen O'Brien, a spokeswoman for Peta, said in a statement that her organisation would regroup as a result of the dismissal of "this historic first case" on behalf of orcas.

"Today's decision does not change the fact that the orcas who once lived naturally wild and free are today kept as slaves by SeaWorld," O'Brien said.

What Do Killer Whales Eat in the Arctic?

ScienceDaily (Jan. 29, 2012) — Killer whales (Orcinus orca) are the top marine predator, wherever they are found, and seem to eat everything from schools of small fish to large baleen whales, over twice their own size. The increase in hunting territories available to killer whales in the Arctic due to climate change and melting sea ice could seriously affect the marine ecosystem balance. New research published in BioMed Central's re-launched open access journal Aquatic Biosystems has combined scientific observations with Canadian Inuit traditional knowledge to determine killer whale behaviour and diet in the Arctic.



Orca have been studied extensively in the northeast Pacific ocean, where resident killer whales eat fish, but migrating whales eat marine mammals. Five separate ecotypes in the Antarctic have been identified, each preferring a different type of food, and similar patterns have been found in the Atlantic, tropical Pacific, and Indian oceans. However, little is known about Arctic killer whale prey preference or behaviour.
Traditional Ecological Knowledge (TEK) is increasingly being used to supplement scientific observations. Researchers from Manitoba visited 11 Canadian Nunavut Inuit communities and collated information from over 100 interviews with hunters and elders.
The Inuit reported that killer whales would 'eat whatever they can catch', mainly other marine mammals including seals (ringed, harp, bearded, and hooded) and whales (narwhal, beluga and bowhead). However there was no indication that Arctic killer whales ate fish. Only seven of the interviewees suggested that killer whales ate fish, but none of them had ever seen it themselves.
The type of reported prey varied between areas. Most incidents of killer whales eating bowhead whales occurred in Foxe Basin and narwhal predation was more frequent around Baffin Island. Inuit were also able to describe first-hand how killer whales hunted, including several reports of how killer whales co-operated to kill the much larger bowhead. During the hunt some whales were seen holding the bowhead's flippers or tail, others covering its blowhole, and others biting or ramming to cause internal damage. Occasionally dead bowheads, with bite marks and internal injuries but with very little eaten, are found by locals.
'Aarlirijuk', the fear of killer whales, influenced prey behaviour with smaller mammals seeking refuge in shallow waters or on shore and larger prey running away, diving deep, or attempting to hide among the ice. Even narwhal, which are capable of stabbing a killer whale with their tusks (although this is likely to result in the deaths of both animals), will run to shallow waters and wait until the whales give up.
Killer whales are seasonal visitors to the area and have recently started colonising Hudson Bay (possibly due to loss of summer sea ice with global warming). Local communities are reliant on the very species that the orcas like to eat. Dr Steven Ferguson from the University of Manitoba who led this research commented, "Utilising local knowledge through TEK will help scientists understand the effects of global warming and loss of sea ice on Arctic species and improve collaborative conservation efforts in conjunction with local communities."

Antarctic Killer Whales May Seek Spa-Like Relief in the Tropics

ScienceDaily (Oct. 26, 2011) — NOAA researchers offer a novel explanation for why a type of Antarctic killer whale performs a rapid migration to warmer tropical waters. Scientists believe that warmer waters help the whales regenerate skin faster, after spending months coated with algae in colder waters.

"The whales are traveling so quickly, and in such a consistent track, that it is unlikely they are foraging for food or giving birth," said John Durban, lead author from NOAA's Southwest Fisheries Science Center in La Jolla, California. "We believe these movements are likely undertaken to help the whales regenerate skin tissue in a warmer environment with less heat loss."

As evidence, the researchers point to the yellowish coating on Antarctic killer whales caused by a thick accumulation of diatoms or algae on the outer skin of the animals. The coloring is noticeably absent when they return from warmer waters indicating the upper epidermis of the skin has been shed.
One tagged Antarctic killer whale monitored by satellite traveled over 5,000 miles to visit the warm waters off southern Brazil before returning immediately to Antarctica just 42 days later. This was the first long distance migration ever reported for killer whales.

The coloring is noticeably absent when they return from warmer waters indicating the upper layer of skin has been shed. The scientists tagged 12 Type B killer whales (seal-feeding specialists) near the Antarctic Peninsula and tracked 5 that revealed consistent movement to sub-tropical waters. The whales tended to slow in the warmest waters although there was no obvious interruption in swim speed or direction to indicate calving or prolonged feeding.

"They went to the edge of the tropics at high speed, turned around and came straight back to Antarctica, at the onset of winter," said Robert Pitman, co-author of the study. "The standard feeding or breeding migration does not seem to apply here."

Researchers believe there are at least three different types of killer whales in Antarctica and have labeled them Types A, B and C.

Extinction looms for last killer whale pod

FOR at least three decades they have made the waters off the west of Scotland their own, delighting visitors and residents alike.
 
But now it seems the country's only resident pod of killer whales is doomed to extinction and pollution could be to blame.

The nine whales have failed to produce a single surviving calf in 20 years and Dr Andy Foote, a world-renowned expert on orcas, believes time has run out for the four males and five females.

The marine biologist has been studying the group, known as the West Coast Community, with the Hebridean Whale and Dolphin Trust and the Irish Whale and Dolphin Group, since 1992. He said: "It's probably too late to save this group. I do believe that they will become extinct in our lifetime which is very regrettable since not many people even know that such a distinctive group of killer whales exist just off our coast."

Little is known about the isolated community, but Foote and the NAKID (North Atlantic Killer Whale ID) project have tracked the group using distinctive fin and body markings and scars to identify them as they move around their home territory.

Since 1981, around 255 sightings of the killer whales have been reported by members of the public from Mull to Tiree and Coll. Sightings have even been recorded off the west coast of Ireland and Wales.

Although there are regular sightings of other orcas off north-east Scotland, the west coasters are believed to be the only resident community - meaning they live in Scottish waters all year.

Observers have even named the community members, calling the males John Coe, Floppy Fin, Comet, and Aquarius. The females are Nicola, Lulu, Moneypenny - she is numbered 007 in the group - Puffin and Ocassus.

John Coe, named after a famous explorer, seems the most famous member of the soon-to-be-extinct family - perhaps because he has the most distinctive looking dorsal fin.

An adult male, Moon, has already disappeared and Foote fears this is just the beginning of the problems that the orcas face.

He believes contaminants could be one of the factors that has stopped the pod from successfully breeding.

"Female orcas store contaminants in their body fat and they pass some of the pollutants in their bodies to their calves when they're feeding. This is another possible reason why there have been no live calves seen."

Foote and the HWDT are appealing to the government for help. He said: "Fire retardants, pesticides and industrial manufacturing chemicals can end up in the water and it is likely that this is causing problems for the west coast group. If we successfully pass legislation that will reduce the amount of contaminants in the water, other countries will look to that and use us as an example, which could in turn help their populations of killer whales."

Such steps are almost certainly too late for John Coe and the rest of the group.

"With large animals like these, the hope of saving them is quite slim. We know they are decades old and the possibility of something like artificial insemination is very unlikely.
"Even if we were lucky enough to catch them, the mothers are almost definitely too old to breed again. Smaller cetaceans can sometimes be translocated if they are failing to breed, but again with their size, this is just not feasible."

Foote said the best they could hope for was to avoid similar tragedies befalling other orcas in Scottish waters.

"We've learned a lesson from this pod," he said. "We can use what we know now to prevent it happening again to our other killer whale communities."

He added: "We would love to learn more about them before they become extinct and the public can help us do that. We're appealing to anyone out there who may have pictures of the west coast group prior to 1992, so that it could help us to learn more about the pod.

"Old photos that haven't been submitted could help us determine how many individuals there were and perhaps how old they are now which could help us prepare for similar scenarios in the future."

Richard Fairbairns, founder of the Hebridean Whale and Dolphin Trust said it would be a "tragedy" if the whales disappeared. "They're very old friends of ours. I was the one who named John Coe a long time ago and not long after that I set up the trust.

"When I first saw an orca off the coast of Coll in the early 1980s, everybody thought I was a complete nutcase. But thankfully, awareness has grown and the whales will have a better chance of surviving if more people know they exist."

Andy Jackson, managing director of Ardnamurchan Charters, which provides boat trips off the west coast of Scotland, said the whales were a major attraction for his passengers.

"But they're not just an attraction, they're an endangered species and that needs to be addressed.

"We're very concerned by the huge level of pollution in our water. Pollution, over-fishing and poor techniques like dredging will all impact this group terribly and you can imagine what it's doing to the less significant species as well."

Orca sighting unnerves triathlete

Triathlete Nicole Walker has always felt uneasy swimming in the ocean, but it was a close encounter with an orca at Oriental Bay that really left her shaking.

Miss Walker was on a training swim about 5pm on Monday, about 80 metres from shore, when she looked down into the water after taking a breath.

"It was just looking up at me, a big black and white face. I could have touched it."

She believes the orca was a calf, and though she "freaked out" and tried to swim as fast as she could for the shore, Miss Walker thinks the whale's head was about 80cm wide.

"It was swimming belly up underneath me. I couldn't believe my eyes."

Though she was swimming as fast as she could, seconds later she saw the orca swimming beneath her again. She was afraid it might come up underneath her "and either grab hold of me or hit me with its tail, and that would be the end of me".

Miss Walker said she was relieved it was an orca beneath her and not a shark, but was scared something might be chasing it.

Still about 40m or 50m from shore, Miss Walker – who was wearing a wetsuit – said she began to panic and look around her.

A group of people had been rowing in the bay, and a man on a rowing coaching boat with a small outboard motor had spotted Miss Walker's frantic swim and gone towards her.

She caught on to the side of the boat and he took her to shore – where she got out of the water shaken but very relieved.

Yesterday, Miss Walker said she was sure the orca had just been curious and wanted to play, but at the time that did not prevent her from panicking.

On shore, she saw a crowd of people had gathered as they could see a mother orca and possibly three calves in the bay.

Though Miss Walker had always felt a little uneasy swimming in the ocean, she had previously felt a bit more comfortable swimming in Wellington because she was in a bay.

However, now she was safely back on dry land she was not letting the experience interrupt training, and planning to get back out into the water tonight.

Conservation Department biodiversity programme manager Peter Simpson said there had been other reports of orca sightings in Wellington Harbour on Monday. The first was about 1pm from a person at the heads who saw the pod coming in.

Orca did come into the harbour occasionally, but why was unknown. They could be following food, or simply curious.

Eighty years ago this week - on Thursday, September 18, 1930 - The Sydney Morning Herald reported the death of one of the most eccentric celebrities of NSW. The body of ''Old Tom'' was found washed ashore near Eden. The paper described him as ''the king of the far-famed pack of Twofold Bay killers'' and ''the last of his tribe''.

The story, ''King of the Killers'', said, ''For over 100 years he and others of the pack, at one time numbering as many as 30'' rendered an enormous service to the community by intercepting migrating whales and trapping them in the bay.

Since the 1840s, the whalers had abided by what locals call ''the law of the tongue''. When the killer whales had helped them with a kill, the whalers would tie the carcass to a buoy overnight allowing the orcas to take their feed.

Both benefited, Smith explains, because the killer whales only ate the lips and the tongue - the keenest meat on a baleen whale, leaving the whalers to harvest the profitable blubber and whalebone later.

Killer whale evolution leads to two orca species (via Chad Arment)

Orcas, commonly known as killer whales, are still evolving, and quickly.

Researchers have discovered that two distinct types of orca, a large and a pygmy form, are rapidly diverging, evolving away from each other.

The scientists' study reveals each type of orca carries a unique gene mutation that benefits its particular lifestyle.

The genetic change has occurred in the past 150,000 years, adding to evidence that the orcas are quickly evolving into two distinct species.

Details of the research are published in the journal Biology Letters by an international team of scientists led by orca expert Dr Andrew Foote of the Natural History Museum of Denmark based at the University of Copenhagen.

Energetic lifestyles
The orcas studied live in Antarctic waters, and are known as type B and type C orcas.

Type Bs are one of the largest forms of orca known and primarily feed on seals.

Type Cs, in contrast, are known as a dwarf-form of orca, and feed mainly on fish.

These differences in size and diet, as well as each type having distinct markings, has led Dr Foote and colleagues to previously propose that they could be two separate species.

Genetic evidence now backs that idea.
Dr Foote and his team analysed the mitochondrial genomes of 15 type B and 36 type C orcas, specifically looking at a gene known as cytochrome B, a gene that plays a significant role in the orca's mitochondria, the structures within cells that govern energy production and metabolism.

They found that type B and type C orcas have evolved different amino acids within this gene, that affect its performance.

All type B orcas have replaced one type of amino acid with another at a place on the gene known as site 279, and type Cs had replaced another amino acid at site 193.

"The mutation has spread throughout each type, so that all type B individuals we analysed the DNA for had the mutation and almost all of the type C individuals had the other mutation," says Dr Foote.

He explains how this mutation could be benefiting each type of orca.

"The gene under selection is important in producing energy for the body's cells, and so the mutations are probably linked to the metabolic requirements of these two types.

"Both types live in the Antarctic pack ice and therefore the low temperature of this habitat could be one selective pressure.

But the two mutations should have the opposite effect on metabolism to one another suggesting divergent evolution."

For example, type C is a dwarf killer whale morph reaching lengths of just over 6m, whereas type B is one of the largest killer whale morphs, being up to 50% larger than type C.

"So body size could also be the selective force on the gene linked to metabolism," Dr Foote told the BBC.

Neither mutation can be found in what is thought to be the mitochondrial genome of the orcas' recent ancestor.

That suggests the natural selection has fixed these mutations very quickly, and they appeared since type B and type C orcas diverged from their most recent common ancestor 150,000 years ago.

Mitochondrial DNA Points to Multiple Killer Whale Species

NEW YORK (GenomeWeb News) – Killer whale "ecotypes," which vary in their choice of prey, behavior, and appearance, represent distinct species, according to a paper appearing online yesterday in Genome Research.

An international research team including researchers from Roche's 454 Life Sciences and Roche Applied Sciences, used highly parallel pyrosequencing to assess the complete mitochondrial genomes of nearly 150 killer whales from the North Atlantic, North Pacific, and southern oceans. In so doing, they identified dozens of mitochondrial haplotypes that point to the existence of at least three killer whale species.

"We recommend that three named ecotypes be elevated to full species, and that two additional types be recognized as subspecies pending additional data," lead author Phillip Morin, a geneticist affiliated with the National Marine Fisheries Service's Southwest Fisheries Science Center and the University of California at San Diego's Scripps Institution of Oceanography, and colleagues wrote.

Killer whales are currently classified as just one species, Orcinus orca. Nevertheless, researchers have identified several so-called killer whale ecotypes that have slightly different size and color patterns, behaviors, prey preferences, and social organizations.

Past studies of specific mitochondrial DNA loci have found relatively little mtDNA diversity, the researchers explained, and just over a dozen haplotypes. Nuclear microsatellite data, meanwhile, hints at the existence of additional genetic diversity and more complex population structure than previously appreciated.

"This low level of mtDNA diversity has resulted in only weak inference of phylogeographic patterns and divergence times in killer whales, limiting our ability to understand their evolution and taxonomy," they wrote. "Killer whales are therefore an ideal candidate species for applying new high-throughput techniques to allow the production of a highly corroborated mitogenome tree and the testing of hypotheses of the timing of coalescence of killer whale populations."

To test the taxonomic and evolutionary utility of high-throughput mitogenomics, the team sequenced the 16,390 or so base pairs of mitochondrial genomes from 143 killer whales using highly-parallel pyrosequencing with Roche 454 GS FLX and Titanium platforms. They also sequenced five partial mitochondrial genomes and mtDNA for three outgroup species: a false killer whale, a long-finned pilot whale, and a short-finned pilot whale.

After tossing out duplicate and poor quality sequences, the researchers were left with 139 killer whale mitochondrial genome sequences representing 66 different haplotypes.

These haplotypes clustered with geography and killer whale type, although whales from a few distant geographic populations grouped near one another, the team explained, suggesting they might share common ancestors.

They estimate that killer whale haplotypes identified in the study diverged from one another between around 150,000 and 700,000 years ago, with clades from the eastern North Pacific apparently diverging earliest and an Atlantic clade diversifying into killer whale groups found in high latitudes today.

Based on their mitogenomic findings, the researchers called for a revised killer whale classification scheme designating two existing killer whale types in the Southern Ocean and one group in the North Pacific as distinct species and recognizing additional subspecies. Even so, the researchers noted, studies of nuclear sequence data are needed to verify and further refine the patterns detected so far.

Overall, the team argued, using genetic information to improve killer whale classifications and taxonomy will help to inform killer whale ecology research and conservation efforts in the future. They also predicted that mitochondrial genome sequencing will play an increasingly large role in classifying other species as well.

"We expect that, as sequencing technologies continue to allow more samples, more sequence, and lower cost the application of mitogenomics will become the default approach to phylogeography, as was previously the use of control region and cytochrome B sequence analysis," the researchers concluded.

Sequence data on the 66 killer whale haplotypes identified in the current study have reportedly been deposited in Genbank.

New genetic analysis splits killer whales into multiple taxa

Determining whether animals belong to the same species is not as black and white as you might think.

Take killer whales. Scientists have long debated whether the ocean-dwelling mammals all belong in one species. Now, DNA evidence suggests that killer whales should be classified in at least four species, and maybe more.

Scientists once thought killer whales all belonged to the species Orcinus orca. But as researchers began observing more closely, they discovered that the whales seem to belong to different groups, called ecotypes, with distinct feeding habits and appearances. Killer whales from different ecotypes don’t seem to breed with each other — one criterion for being classified as separate species. So some scientists proposed that killer whales should be grouped into different species.

Early genetic analyses didn’t support that idea. Studies that looked at pieces of mitochondrial DNA, a type of genetic material that can be used as a molecular clock to measure the time since two genetic lineages split, concluded that the various killer whale groups are similar enough to fall into a single species.

But recently, researchers have come to realize that not all molecular clocks keep the same time. The mitochondrial DNA of Adélie penguins, for example, evolves faster than previously thought (SN Online: 11/17/09). Killer whales and other cetaceans, on the other hand, have molecular clocks that tick more slowly than other species’ clocks do, says Phillip Morin, a marine mammal geneticist at the Southwest Fisheries Science Center in La Jolla, Calif.

Morin and colleagues analyzed the mitochon­drial genomes of 139 killer whales from around the globe and found that the animals fall into several genetically distinct groups.

“The genetic data show that they are each independently evolving lineages,” Morin says.

There is enough evidence to split off three new killer whale species, Morin and his colleagues propose in a study published online April 22 in Genome Research.

Two of the proposed new species live in the Antarctic. One eats only marine mammals, frequently knocking seals off pack ice to catch its prey. The other pursues fish underneath the pack ice.

A third proposed species lives in the northeastern Pacific and eats a variety of other marine mammals, including seals, sea lions, whales and dolphins. Morin’s team estimates that this group diverged from other killer whales as a separate species about 700,000 years ago. The other groups split off more recently.

“I suspect there’s going to be another four or five species,” says Robin Baird, a cetacean biologist at the Cascadia Research Collective in Olympia, Wash. Killer whales seem to be evolving into new species based on their eating habits, he says, a scenario that is common among birds but extremely rare for mammals.

Not everyone is convinced, however. Mitochondrial DNA is passed from mothers to offspring, so it reflects only one part of a species’s genetic heritage, points out A. Rus Hoelzel of Durham University in England. Going yet another step by analyzing the full DNA makeup of killer whales might reveal genetic exchange between killer whale groups that is not detectable looking exclusively at the maternal lineage. Exchange of genetic information between the groups would indicate that they aren’t separate species.

Morin agrees that a fuller genetic picture of killer whales is called for; he thinks the additional data will validate the finding from mitochondrial DNA that orcas should be classified into a handful of distinct species.

“My gut feeling is that these really are separate species, but the careful scientist in me wants to get a little bit more data ... to really nail it down,” he says.

Suspected killer whale seen off Gwynedd coast

SEA life experts are studying a picture of a suspected killer whale seen off the coast of Gwynedd.


A-level student Jenny Donelan and her mum Carys Roberts spotted the giant mammal off the beach at Criccieth, and the 18-year-old snapped it with her camera.

Sightings of killer whales are extremely rare off the Welsh coast with fewer than one a year – and mostly around Pembrokeshire.

The Sea Watch Foundation is now investigating the picture.

Expert Gemma Veneruso, from the Foundation, said they were trying to establish if it was a killer whale (Orca) or a large bottlenose dolphin, and have asked the public to come forward if they had similar sightings.

Jenny, 18, a student at Coleg Meirion-Dwyfor in Pwllheli, said: “We were on the beach at Criccieth when mum spotted this very large fish in the water.

“I turned and saw it and took the picture as it splashed into the water but didn’t really realise what we had seen, only that it was very big.

“I have seen dolphins off the coast before and it was much larger.

“It was only later when we looked at the picture we realised it could have been a killer whale. You can see how big it is by the size of the fish it has thrown out of the water.

“It was not far off the coast probably no more than the length of a tennis court.”

Members of the Sea Watch Foundation believe it could be a killer whale but could not clarify it 100% as it was not clear enough on the picture.

Gemma said: “Sightings of killer whales off the Welsh coast are once a year events or even rarer than that so this would be unusual but certainly possible.”

Jenny added: “A friend who has a fishing boat has told us he has seen a number of seals with their heads bitten off around the coast, which he believes could be a sign a killer whale is in the area.

“I am now planning to go out in the boat as this has got me really interested.”

Killer whale attacks dolphin in front of tourists in New Zealand

An orca whale has killed a dolphin and her pup in front of a group of tourists who captured the rare event on video.

The whale was in a pod of about eight which targeted a larger number of smaller dolphins.

The attack happened at a seaside beauty spot called Black Rocks, in the Bay of Islands, New Zealand. Rob Hunt from New Zealand company Explore Images which arranges nature tours and takes photos to help tourists enjoy their experience was on the boat.

The event was a "one in a million" chance, he said. "The boat was just 50 to 100m away while the killing occurred," he added.

He said markings showed it was a female killer whale that chased the doomed dolphin after apparently singling it out.

"It chased it for several minutes, playing with it before flicking the unfortunate creature about 10 metres into the air, then breaking its back on her nose.

"We have been in operation for a little over two years and take on average 400 photos of wildlife a day in addition to tourists interacting with nature.

"I have never known anything like this before to be captured on film. This is mother nature at its most brutal, a rare occurrence that it was seen by humans, and even more rare that it was captured on camera.

The debate has raged for years.

Animals used in theme park shows are important in educating the public on particular species, some say.

Then again, these shows are fraught with danger and people should not share the same tank or cage with aggressive animals, others say.

The old arguments flared up again after orca trainer Dawn Brancheau died Wednesday at SeaWorld in Orlando. Brancheau, 40, had just finished a show with Tilikum, a 12,000-pound killer whale, when the animal grabbed her by her ponytail and dragged her underwater.

Autopsy results show Brancheau most likely died from multiple traumatic injuries and drowning after the whale pulled her into a pool, authorities said.

Chuck Tompkins, the corporate curator of zoological operations for SeaWorld, said all procedures were followed and the death of Brancheau was a tragic accident. Orca shows have been suspended indefinitely.

But the park has been offering marine mammal shows for 46 years and the programs are an important part of learning about the animals, Tompkins said.

"Obviously, we need to evaluate our safety procedures and how we work with these animals, Tompkins said. "But we need to move forward knowing these animals are an incredible, valuable tool for us to learn about them."

Robert Rose, the curator of the Miami Seaquarium, agreed.

"These animals serve a very specific purpose," he said. "They're ambassadors to animals out in the wild. Through parks like ours, you can be entertained and learn about these animals."

But Naomi Rose, a marine mammal scientist with The Humane Society of the United States, said the image presented by the theme parks that the animals are "happy performers" is not true.

As long as orcas are used in interactive shows, incidents involving injury and death are "absolutely going to happen again," Rose said. Orcas, she said, are large predators, "unsuited to permanent confinement, often exhibiting neurotic behaviors in these settings."

Whales and dolphins are intelligent, socially-complex predators that often hunt in pods, Nancy Black, a marine biologist and orca expert with the Monterrey Bay Whale Watch in California said.

"We know so much about their intelligence, their social structures," Black said. "We know they need a lot of space. Living in a tank only stresses them. They are too intelligent for that."

She rejected arguments that parks with orcas in captivity offer educational opportunities and do research into the species. Black promotes excursions into whales' natural habitats.

"There are so many opportunities to see these animals in the wild," she said. "And it costs just as much to go whale watching than go to SeaWorld."

Tompkins agreed that orcas are social animals but said Tilikum exhibited no strange behavior before he pulled his trainer into the water.

"Everything seemed absolutely normal with him," Tompkins said. "There was no abnormal behavior with any other killer whale in the environment, so nothing would lead me to believe that there was anything different in the environment or wrong."

SeaWorld said Tilikum will be kept in isolation and not released into the wild. Russ Rector, a former dolphin trainer at Ocean World in Ft. Lauderdale, said Tilikum won't be set free because the orca would probably attack beachgoers.

"Once an animal kills, it's going to kill again," Rector said.

As for the orca's isolation, Rector said it's because Tilikum is used in breeding and he's worth millions to the theme park.

"If this was a big cat or an elephant that hurt somebody, it would be put down," said Rector, who left the industry after he became vocal about how trainers and marine mammals were treated. He is now a marine animal activist and a rescuer who founded the Dolphin Freedom Foundation.

"This industry is a monster with a happy face," Rector said.

Robert Rose, the Seaquarium curator, said the care and wellbeing of the animals is the trainers' top priority.

"This is what we do for a living," Rose said. "We care for these animals 365 days a year, building a relationship and rapport."

Tompkins said orca trainers at SeaWorld parks are highly specialized.

"Obviously, you don't step in front of a whale on your first day," he said. "It's years before you interact with these killer whales. They're taught about the animals; how to train, how to handle themselves, how to react in just about every environment."

Rector said it doesn't take much to become a marine animal trainer who starts with dolphins and move up the ranks.

"If you look good in a bathing suit, you can do it," he said.

Marine theme parks also downplay the daily injuries trainers receive from agitated or aggressive animals.

"They hurt trainers every day. You just don't show your bites," Rector said. "Captivity dements dolphins. They get tired of people. They go crazy when you put them in pools and make them do stupid pet tricks."

Robert Rose said aquatic parks have an enormous amount of safety protocols in place and trainers form strong bonds with animals to be able to sense when something is wrong.

But Rector said there's only one reason why humans even risk getting in the same tank with megaton predators that dwarf them.

"One word: money," he said. "Orcas are worth more than people. It's a cash cow."

There are 24 orcas in parks across the U.S. and 42 in captivity around the world, said Naomi Rose, the marine mammal scientist from the Humane Society. The last wild capture of an orca was in 2005 when Russia netted a pair, she said.

"Both died within a month," she said.

KILLER whale Tilly who attacked and drowned his trainer will not be put down – and may even perform again.

SeaWorld in Florida said last night that six-tonne Tilly is to be spared.

He will remain at the marine fun park, where experts will care for him.

There was an outcry after the giant mammal grabbed his trainer Dawn Brancheau’s ponytail and dragged her to her death in front of a horrified crowd.

Tourists at the park in Orlando, Florida, watched helplessly as the beast “thrashed her around” in the water like a doll.

Tilly, blamed for killing two other people, then swam under water with Dawn, 40, and refused to let her surface.

She died from “multiple trauma injuries” and drowning, an interim post mortem found.

There were angry calls for the “rogue” whale to be executed as a danger to humans.

He also drowned another trainer in 1991, and there was a bizarre incident in 1999 when the body of a naked drowned man was found on the whale’s back.

But animal rights activists demanded the whale should be freed into the ocean.

David Phillips, of the International Marine Mammal Project for the Earth Island Institute, said: “The vast majority
of orca whales in captivity would be better off if they were returned to the wild.

“Orcas are unbelievably ill-suited to life in theme parks and can be successfully released into the wild.”

David, who led the effort to rescue and release killer whale Keiko, made famous by the 1993 movie Free Willy, added: “Orcas deserve a better fate than living in cramped pools. This isn’t the first time stressed-out orca whales have injured or killed people and it won’t be the last.”

But SeaWorld have decided to keep Tilly.

Chuck Tompkins, Corporate Curator of Zoological Operations at SeaWorld Parks, said: “Tilly will not be killed.”

He added that bosses would be looking at safety procedures while keeping the whale in the safest possible environment.

Tilly will mingle with other whales at the park, some of which it fathered.

Chuck added: “We’re going to physically and mentally take care of him. It’s too early to say that he won’t perform again.”

Yesterday tourists released grim pictures of the last moments of Dawn, who had worked at the theme park for 17 years.

Chuck said: “He grabbed her hair and pulled her under.”

At SeaWorld in Orlando, Fla., Wednesday, a killer whale turned on its trainer, pulling her below the water and thrashing her around until she drowned. Trainer Dawn Brancheau was one of the park's best killer whale trainers, with 16 years of experience working with the animals.

Chuck Tompkins, SeaWorld's curator of zoological operations, told ABC News that Tillikum, the killer whale, may have reacted to seeing Brancheau's ponytail swinging in front of him. "Dawn had very long hair in a ponytail. That ponytail had swung in front of him. He grabbed her by the hair and pulled her underwater and held her," Tompkins said.

A day after the attack, many questions remain. Why was the whale still performing with a human after it had been involved in two previous deaths? Did the whale show any signs of agitation before the attack?

But the biggest question, which we ask you today: Should Tillikum be euthanized?

(CBS) Animals kill people. People kill animals. People kill people, animals kill animals. The strong prey on the weak, the smarter species prey on the less intellectually well endowed. So it goes on planet Earth.

This week, a 12,000-pound male killer whale named Tilikum grabbed his human trainer in his mouth and drowned her in his SeaWorld tank in Orlando, Fla.

Tilikum has a violent history. In 1991, Tilikum and two female killer whales killed a trainer by drowning in Victoria, British Columbia. In 1999, the orca killed a man who had sneaked into the SeaWorld tank for a swim with the whales.

Tilikum is a serial killer. Perhaps, he should have been put into a higher security facility after the first, or even second, act of violence.

Chuck Tompkins, curator of zoological operations at SeaWorld Orlando indicated that the marine park plans to continue using Tilikum in its shows. "We need to evaluate our handling procedures and how we interact with him .... I can guarantee we will make any change necessary," he said.

Despite Tompkins' wishes, Tilikum, who is an acknowledged member of the top predator species in the ocean, could face the death penalty via lethal injection for his actions.

While Tilikum's actions cannot be condoned, he is also a product of his environment.

Tilikum is a wild animal, by human standards. But in the oceans of the world, the orca dominates as humans do on terra firma. Whales might think of humans as wild animals; diminutive creatures who nonetheless prey on them.

Orcas have an intelligence optimized for their environment. Their brains are nearly four times the size of a human brain. While brain size doesn’t necessarily equate into more intelligent behaviors, at least from a human point of view, according to various studies whales exhibit complex communication, elaborate social structures and cognitive capabilities, including learning-based foraging, cultural variation and possibly mirror self-recognition.

"I don't doubt the intelligent behavior in whales," said Dr. Patrick Hof, a professor of neuroscience at the Mount Sinai School of Medicine who has done research on whale brains. "The brain of the whale is organized quite differently from the primate brain, especially when you look at microscopic architecture of the cerebral cortex. It's quite likely as a result of adaptation over millions of years to the aquatic environment. The whale brain is wired completely differently from a chimpanzee or human, but it has functions that other animals don't have."

But no one is going to read Tilikum his rights or provide a court-appointed lawyer. The whale-human language interface has not evolved enough for inter-species communications at that level.

It could be that Tilikum needs to be represented by an attorney. A defense lawyer could claim that Tilikum was captured by humans against his will, and has been confined to small space. He is unable to socialize with his pod, which is very family-oriented, and is under extreme duress in an unnatural habitat.

He has also been exploited by marine parks for his splash and studliness. Like a Kentucky Derby winner, Tilikum is worth millions for his sperm, impregnating female orcas who spawn the offspring that puts people into the seats of SeaWorld and other marine parks.

"The setting of SeaWorld is completely foreign to whales,” said Dr. Hof. “A killer whale is a predator, a wild animal. Their hunting behavior is well documented and they can become extremely aggressive. The same situation has happened to elephants in Africa with the pressure of a growing human population encroaching on their habitat. They become anxious and stressed, and can become aggressive.

"In the end, it's an impoverished environment compared to their natural habitat-a big swimming pool, enriched food and some activity programs."

Tilikum cannot defend himself or be judged by a jury of his peers. The human judges should take into account the extenuating circumstances that brought the orca to this juncture.

Killer Whale Trainers Are Like Astronauts

Of course there are dangers when we work with animals but the risks are worth it.

Jack Hanna spoke with "America's Newsroom" host Bill Hemmer on Thursday, February 25.

I knew Dawn, and obviously I'm still in shock with this whole thing. I've actually done stand-ups with Tili in the background over the years when I do "Whales In the Wild -- Killer Whales," I do my stand-ups there. I just want to say real quickly that if Steve Irwin when he died, he would have wanted his legacy carried on, I know Dawn would have, I know if something happens to me, I would have. Because it's an incredible thing what these folks do. These killer whale trainers are like astronauts, they're like Olympic athletes. Dawn, especially was at the top of this entire group of very few people in the world that are killer whale trainers. It says "killer whale" which means it's a dangerous animal. Just like the guys that work with elephants in zoos, the largest land mammal, things happen. Just like when our space shuttle went up and came back and those astronauts were killed. But what did they do? They went back up into space. You know something? I hope SeaWorld continues what they do.

Now as far as Tili...the news is correct, there were two previous deaths. But let's face it, the one several years ago -- it was not SeaWorld's fault or Tili's fault. Someone snuck into the park, at nighttime, at 1:00 a.m. in the morning, jumped in with the whale. -- That's like me jumping across the fence at a NASCAR race and getting hit by a car. The previous death, yes, in Canada, that was Tili. But I have take my hat off to SeaWorld for taking this animal to SeaWorld where this animal has produced..many babies. That is so valuable to the killer whale population. One last thing, most all animals, most all the whales at SeaWorld, were born at SeaWorld, not in the wild. Ninety-nine percent of our animals born at zoos are born at zoological parks, not the wild. People don't know these facts.

And I can tell you that Dawn was an incredible human being and she loved everything she did, and... I just hope that SeaWorld continues the great work.

They're killer whales, they're dangerous animals, and we all know the jobs we have to do. You know, out of one million plus interactions that trainers have had with whales, this is the first time that someone has been killed at SeaWorld, as far as a trainer is concerned and no one ever swam with Tili at SeaWorld.

Florida whale shows will go on after deadly attack

US entertainment park SeaWorld plans to resume killer whale shows at its facilities yesterday, just days after an orca it described as "an important part of our team" killed a trainer in front of horrified onlookers. "He will remain part of our team," SeaWorld Parks and Entertainment president Jim Atchison said of the whale that killed trainer Dawn Brancheu. "Tilikum is an extraordinary animal," he added. "He is a very special animal that requires very special handling.

Trainers will not be allowed into the water with the Florida marine park's killer whales until a thorough safety review has been completed and its recommendations implemented, he said. Tilikum-a five-tonne orca already linked to two other human deaths since 1991 -- grabbed Brancheau, 40, by her ponytail on Wednesday and dragged her into the water at the end of a show at SeaWorld Orlando.

Atchison addressed reporters Friday at a sometimes tense press conference that took place in front of an underwater observation tank, where seven of the park's orcas swam peacefully. Tilikum was not present. He told reporters, who were escorted one at a time into the park to the observation tank, that Tilikum would not face punishment or isolation. "It's important that I again stress that we provide the highest standard of care and no animal is ever subject to punishment in any form. Tilikum is no exception.

Colleagues from other marine parks in Miami, Georgia and Niagara Falls as well as the United States Navy are assisting in the park's internal investigation, as preparations are made for funeral services for Brancheau in Chicago today and tomorrow. Multiple outside agencies are also investigating the tragedy, including the Orange County, Florida, Sheriff's Office and the US Occupational Safety and Health Administration.

The US Department of Agriculture, which administers the federal Animal Welfare Act, will also conduct an inspection. SeaWorld has scrambled to prevent the gruesome attack from becoming a public relations disaster that could hit its lucrative marine show business, and Atchison rejected comparisons between Wednesday's incident and two prior human deaths involving Tilikum.

Those incidents and (the) nature of them had nothing to do with the nature of this event... and are not relevant to his particular altercation," he said. He acknowledged that Wednesday's event was videotaped, but said the footage is part of the ongoing investigation. He also defended the shows and exhibits as educational and an "extraordinary way for people to make connections with marine animals.

Witness Sue Nichols, 67, said the crowd had no warning that anything was brewing as the show was already ending with most of the 50-strong audience having left their seats. The trainer would "pet him, and she would get very close to him. She'd throw fish in his mouth and throw buckets of water in his mouth, which he seemed to enjoy. There was nothing aggravating or anything about it," Nichols told AFP.

She was petting the whale and talking to him, and then all of a sudden he just reached up. He got her in the water, and he took her underwater, and he had her under for quite a while," she said. "He came up out of the water, and he had her in his mouth." Despite the apparently harrowing nature of the attack and wide media coverage, park officials said attendance numbers had not dropped off.

Casey Morgan, 36, visited the park Friday with her husband. "It's going to have to go on. Life goes on," said Morgan, visiting from Alberta, Canada. "We can't just stop and live inside a bubble." The park's chief zoological officer, Brad Andrews, said employees were saddened by Brancheau's death but looking forward to resuming the shows. - AFP

A trainer at the SeaWorld park in Orlando, Florida, has died after being attacked by a killer whale.

Witnesses said the whale had jumped and grabbed Dawn Brancheau by the waist from a poolside platform before dragging her underwater.

Guests were evacuated while fire crews tried to rescue the 40-year-old, but they were unable to revive her.

The orca, Tilikum, was also involved in the death of a female trainer in Canada in 1991, reports said.

Other orcas were also said to have attacked trainers at SeaWorld parks in 2006 and 2004.

'Shaking her violently'

Chuck Tompkins, SeaWorld parks' head of animal training, was quoted by Reuters news agency saying: "She was rubbing the killer whale's head, and [it] grabbed her and pulled her in."

SeaWorld said an investigation was under way into Wednesday afternoon's death of Ms Brancheau, a trainer with 16 years' experience.

Jim Solomons, a spokesman for the Orange County Sheriff's Office, said early accounts indicated she could have slipped and fallen into the tank.

He said it was too early to tell if she had been attacked by the 12,000lb (5,450kg) orca.

But witnesses told a different story.

Park visitor Victoria Biniak told a local TV channel that the trainer had just finished explaining to the audience what they were about to see.

At that point, she said, the whale "took off really fast, and then he came back around to the glass, jumped up, grabbed the trainer by the waist and started shaking her violently. The last thing we saw was her shoe floating."

Audience member Eldon Skaggs told AP news agency the whale had "pulled her under and started swimming around with her".

A male spectator who witnessed the tragedy gave CNN a similar version of events.

Brazilian tourist Joao Lucio DeCosta Sobrinho and his girlfriend were at an underwater viewing area when they saw the whale with the trainer in its mouth.

The entertainment park, known for its killer whale, seal and dolphin displays, was closed after the incident. SeaWorld in San Diego also suspended its killer whale show.

Tilikum is said to have been involved in previous incidents, the BBC's Andy Gallacher reports from Florida.

A SeaWorld spokesman said the orca had been one of three whales blamed for killing a trainer in 1991 after she had fallen in a pool at a marine park in British Columbia, Canada.

Naked man

After the whale - nicknamed Telly - was sold to SeaWorld Orlando it was involved in a second incident when authorities discovered the body of a naked man lying across his back in 1999.

Officials later concluded the man, who had either crept into SeaWorld after closing time or hidden in the park until it closed, probably drowned after suffering hypothermia.

There have been incidents involving other whales at SeaWorld.

In November 2006, a male trainer escaped with a broken foot after he was bitten and held underwater by a female killer whale during a show at SeaWorld's San Diego park.

In 2004, another whale at the company's San Antonio park attempted to bite a trainer, but he too escaped.

Though called a killer whale, the orca (Orcinus orca), is actually the largest member of the oceanic dolphin family.

Animal rights group Peta says it has long been asking SeaWorld to stop taking wild, ocean-going mammals and confining them to an area that, to them, is "the size of a bathtub".
