SeaWorld sued over 'enslaved' killer whales

Five killer whales have been named as plaintiffs in a lawsuit which argues they deserve the same constitutional protection from slavery as humans.
A US judge is considering a complaint by People for the Ethical Treatment of Animals' (Peta) against SeaWorld.
It is reportedly the first time a US court has heard legal arguments over whether animals should enjoy the same constitutional protections as humans.
SeaWorld's legal team said the case was a waste of time and resources.
The marine park's lawyer, Theodore Shaw, told the court in San Diego: "Neither orcas nor any other animal were included in the 'We the people'... when the Constitution was adopted."
He said that if the case were successful, it could have implications not just on how other marine parks or zoos operate, but even on the police use of sniffer dogs to detect bombs and drugs.
'Historic case'
Peta says the killer whales are treated like slaves for being forced to live in tanks and perform daily at the SeaWorld parks in California and Florida.
It is not considered likely that the whales will win their freedom, but campaigners said they were pleased the case even made it to a courtroom.
The lawsuit invokes the 13th Amendment to the constitution, which abolished "slavery or involuntary servitude" in the US.
Jeffrey Kerr, the lawyer representing the five whales, said: "For the first time in our nation's history, a federal court heard arguments as to whether living, breathing, feeling beings have rights and can be enslaved simply because they happen to not have been born human.
"By any definition these orcas have been enslaved here."
Hearing the arguments for about an hour, US District Judge Jeffrey Miller raised concerns over whether animals could be represented as plaintiffs in a lawsuit.
He will issue a ruling at a later date.
Peta names the five wild-captured orca plaintiffs as Tilikum and Katina, at SeaWorld Orlando; and Kasatka, Corky, and Ulises, at SeaWorld San Diego.
It is not Tilikum's first time in the media spotlight - he drowned his trainer before horrified spectators in February 2010, prompting a ban on the Florida park's employees entering the water to perform tricks with the orcas.
The same whale has also been linked to two other deaths.

Crowds thrilled as whales feast on birds

A POD of four killer whales kept a crowd of wildlife watchers entranced for hours on a still afternoon in Shetland on Sunday.

An adult female orca led one immature whale and two even younger whales from the south west tip of Shetland at West Voe round to the east of the islands, swimming up to Mousa Sound where they were last seen in the afternoon as it got dark.



Shetland Wildlife tour operator Hugh Harrop said upwards of 200 people were watching the whales by the afternoon, causing gridlock on the roads in the area as more people heard about their arrival.

Mr Harrop said the most exciting part of the experience was observing the two youngest whales catching small birds, an unusual but not unheard of spectacle.

“We witnessed the two young ones turning on a sixpence, diving and slapping their tails and watched a long tailed duck come to a bitter end. When I got home and downloaded the images I could see there were loads of black guillemots there too,” he said.

“The youngest whales were certainly hunting birds, which is unusual but not unknown in Shetland where there have been at least two documented cases.”

He suggested it was probably play rather than hunger that brought about such behaviour. “Pretty much anything marine is on their diet,” he added.

Killer whales are regular visitors to Shetland waters and Mr Harrop said he would be sending details of this latest sighting to Dr Andy Foote of the North Atlantic Killer Whale ID (NAKID) Project to add to the growing information base on these creatures.

Shark beaches itself to avoid Killer Whale attack

The incident took place at Tuatapere's Blue Cliffs beach in Southland, New Zealand, where eyewitness and local farmer David Evans recorded footage of the attack taking place.

'We were just sort of sitting down to have breakfast and the farmers from the down the road came up and said they'd been watching whales, so we all just piled in the truck and grabbed a camera, grabbed the video and just went down to the beach and just started videoing,' said Mr Evans to New Zealand's TV3 Television.

The whale can be seen in the distance making aggressvie body movements, 

The shark manages to escape the whale by swimming to shallow waters and beaching itself. 

'It would appear the whales were fighting the sharks. The sharks were coming ashore because they didn't want to be in the water,' said Blue Cliffs Beach resident Peter Robinson.

Close to another section of the beach, six more Orcas were spotted along with a school of sharks. 
Small shark are commonly targeted as prey by Orcas.

Killer whales spotted off Cornish coast

Two killer whales were spotted by walker Dom Clarke 100 metres off the coast of Cornwall.


Mr Clarke saw the endangered predators swimming along the British coastline whilst walking along the coast of Padstow.


Mr Clarke, who runs Explore the Shore, a rock pool exploration company, saw a six metre long whale and then a second smaller one, thought to be a calf.

The sighting comes as experts reveal more predators like sperm and killer whales - also known as orcas - are flocking to British shores due to warmer sea temperatures.

Mr Clarke said: "I couldn't believe it, it is certainly not what you expect to see while you're walking your dog.

"It's not totally unheard of for killer whales to be off the coast of England but it's certainly incredibly rare.

"It was amazing how clearly they could be seen. I first noticed a magnificent dorsal fin coming out of the water.


"People look out for porpoises and dolphins in Cornwall but you don't expect to see a killer whale.

"There was another man walking too and I grabbed his binoculars to get a better look.

"There was no mistaking what it was. I was just gutted I didn't have a camera."

Killer whales have a distinctive black and white colouring and males can grow up to eight metres (26ft) long and their dorsal fins can reach up to two metres (6ft).

They are the largest members of the dolphin family, weighing up to six tonnes, and are typically found in the Arctic and Antarctic seas and in warmer waters like the coast of Australia.

The sighting, which was made last week, follows news that more predators are likely to be found in waters around the South West of England as water temperatures rise.

It is thought that some species are hunting for new territories as global warming bites.

A dwarf sperm whale was spotted for the first time in the UK off the coast of Mount's Bay, in Cornwall, this autumn.

And experts now expect the 16-metre (52ft) grey whale to one day be found in water around Cornwall.

The whales, which can weigh 36 tonnes are usually found in the North Pacific and North Atlantic oceans.

Peter Evans, director of the Sea Watch Foundation, said: "We are now seeing a number of species far from home, and they probably will continue to recur with increasing frequency.

"Several are normally found off West Africa. For the moment they tend to be seen at times of year when our sea temperatures are at their warmest.

"Whales and dolphins can cope with a wide range of temperatures but their fish and squid prey tends to be more constrained, and their ranges are extending significantly northwards.

"The dwarf sperm whale was a big surprise when it was spotted.

"If the fish are extending their range, as we know many are, then the whales and dolphins will follow.

"Anchovies for example were really quite scarce in the North Sea 10 to 20 years ago.

"Now they are widespread and may be why the common dolphin is now a regular in the North Sea."

PETA Sues SeaWorld Under US Slavery Law

An animal rights group has sued SeaWorld on behalf of its whales under an American law abolishing slavery.

People for the Ethical Treatment of Animals (PETA) claim the chain of theme parks violate the rights of killer whales under the 13th Amendment of the US Constitution.

Five performing whales at SeaWorld - Tilikum, Katina, Corky, Kasatka, and Ulises - are listed as plaintiffs in the complaint.

"All five of these orcas were violently seized from the ocean and taken from their families as babies," said PETA president Ingrid Newkirk.

"They are denied freedom and everything else that is natural and important to them while kept in small concrete tanks and reduced to performing stupid tricks," she said.

SeaWorld San Diego labelled the lawsuit, filed in the city on Tuesday, as "offensive".

A park statement said that PETA's efforts to "extend the Thirteenth Amendment's solemn protections beyond human beings is baseless and in many ways offensive."

David Steinberg, a professor at the Thomas Jefferson School of Law in San Diego, called the suit "patently, absolutely frivolous".

"The 13th Amendment abolished the abhorrent, despicable practice of the slavery of human beings," he said.

"PETA is demeaning the integrity and humanity of people who were owned as slaves. That is outrageous."

The lawsuit seeks a court order requiring SeaWorld to release the five killer whales to a "suitable habitat".

One of the whales, Tilikum , killed a trainer in Orlando last year by dragging her underwater. The incident raised an outcry about safety and animal rights.

The suit lists PETA and two former SeaWorld employees who have become activists opposing the captivity of marine mammals as "next friends" bringing the suit on behalf of the whales.

PETA, famous for its "I'd Rather Go Naked Than Wear Fur" campaign, has undertaken a number of controversial actions in the past in seeking to advance the cause of animal rights.

What is killing killer whales?

Killer whales, the ocean's fiercest predators, are easily recognisable by their black and white markings.
But their future seems less clearly defined.

Marine experts are concerned about an invisible threat to the animals that has been building in our seas since World War II.

That was when industries began extensively using chemical flame retardants, such as PCBs.

These chemicals were later found to harm human health and the environment, and governments around the world banned their use in the 1970s.

But their legacy lives on in the world's seas and oceans, say biologists, posing a modern threat to animals such as killer whales, also known as orcas.

Small population
Ingrid Visser grew up watching killer whales, the largest members of the dolphin family, from the shores of her native New Zealand. She has dedicated her life to knowing more about the animals.

The island nation's orca population is made up of fewer than 200 individuals and as such is listed as threatened.

"They hunt in New Zealand waters in the shallows for the rays and in deeper waters for the sharks," says Dr Visser.

"[These] orca are unique as they are the only population that has so far been recognised to specialise in hunting for rays and sharks."

But according to Dr Visser's studies, this diet could be the reason the population is not growing.

As large mammals, killer whales consume a large amount of prey.

But this position at the top of the food chain, as "apex predators", makes them particularly vulnerable to changes in their prey.

That is because orca feed on fish that in turn eat polluted prey or absorb pollution from the water. So the orca ingest all of the pollution in the chain, in a process called "bioaccumulation".

Dr Visser says her studies of the bodies of stranded orca and the sharks and rays they feed on have confirmed this fear.

"Their prey is definitely polluted - we are seeing spikes in the same chemicals as are seen in the orca," she says.

New Zealand orca are not the only ones living with pollution, according to Alex Rogers, Professor in Conservation Biology at the University of Oxford, UK.

"Studies have identified high levels of flame retardant chemicals in orca particularly from the Northern Hemisphere, for example from the north Pacific, particularly off Canada and the Arctic," he says.

"These chemicals have also been found at high concentrations in orca from the Southern Hemisphere."

PCBs (polychlorinated biphenyls) were banned globally from the 1970s.

In recent years, the European Union has also banned the use of PBDEs (polybrominated diphenyl ethers) in foam for furniture and electrical devices due to their potential toxicity.

"The two main groups of flame retardant chemicals, PCBs and PBDEs have a range of effects on animals including interference with thyroid function and vitamin A metabolism, negative effects on neurological and reproductive development and impacts on immune function," says Prof Rogers.

Persistent threat
But despite actions to limit use of these chemicals, also referred to as persistent organic pollutants (POPs), marine experts suggest the damage has already been done.

"PCBs are not water soluble, they only dissolve and accumulate in fatty tissue," says Dr Paul Jepson from the Zoological Society of London.

Dr Jepson says this fat solubility is a considerable issue for female cetaceans such as killer whales who feed their young for up to a year on high fat milk to kick-start their development.

"You get this huge maternal transfer. It's been calculated that in whales and dolphins about ninety percent or more of the mother's body burden of PCB can be offloaded, particularly to the first calf," he tells BBC Nature.

POPs are a problem that is not going away.

"Even though PCBs have been banned they're just so resistant to break down in the environment. The decline of these pollutants is happening very slowly," says Dr Jepson.

In his role as co-ordinator of the UK Cetacean Strandings Project Dr Jepson regularly comes into contact with marine mammals.

His studies into harbour porpoises, common to UK waters, have highlighted the ongoing impact of the chemicals.

"We're not really finding any decline at all in PCBs in our harbour porpoises... levels in the UK appear to have plateaued since about 1997."

Dr Jepson says that Dr Visser's findings could pose a serious cause for concern for orca worldwide, especially those in seas close to heavily populated and industrialised nations.

"Pollutant levels, particularly with PCBs, will be much higher in European waters than they would in New Zealand," says Dr Jepson.

"If they are finding quite high levels in orcas in New Zealand it's really quite worrying for us."

Little-known facts
This remains a controversial area of study however due to the elusive nature of the subjects.

Orca have the most cosmopolitan distribution of any animal, being found in every ocean around the world.

But their wide-ranging territories, predatory nature and deep-sea lifestyles have restricted long-term studies to determine population sizes.

There is precious little opportunity to study the animals on land either as orca rarely strand: Dr Jepson's last encounter with one on the UK coast was 12 years ago.

Not much is known therefore about the causes of orca's deaths and what, if any, pollutants are in their bodies.

Dr Visser however is determined to record New Zealand's orcas in the hope they will provide information that will help conservationists worldwide.

To do this, the scientist is literally immersing herself in the world of the killers: diving with the animals to document their behaviour and health.

Without in-depth studies of populations around the world, there will not be enough evidence to truly know whether populations are in decline.

Paternity Testing Helps Fill in Family Tree for Puget Sound's Killer Whales: Inbreeding Could Reduce Whales' Genetic Diversity

ScienceDaily (July 21, 2011) — In a study published online this month in the Journal of Heredity, NOAA researchers and others, using DNA testing to fill in a missing link in the lives of killer whales that seasonally visit Washington's Puget Sound, have discovered that some of the progeny they studied were the result of matings within the same social subgroups, or pods, that are part of the overall population.


One implication of this inbreeding behavior is a significant reduction in the genetic diversity of what is already a perilously small population of animals, formally known as Southern Resident killer whales. That population numbers only about 85 animals and was listed as endangered under the federal Endangered Species Act in 2005.


Southern resident killer whales, which also visit the waters of British Columbia and are occasionally found as far south as Monterey Bay, Calif., consist of three pods called J, K and L pod. Inter-pod mating has never been detected in studies of Northern Resident killer whales, which range from Washington to southern Alaska, and until now researchers assumed that Southern Residents exhibited similar mating patterns. The two populations are distinct and do not socialize with each other.

The study, titled "Inferred paternity and male reproductive success in a killer whale (Orcinus orca) population," involved researchers from NOAA's Fisheries Service, the University of Washington, Cascadia Research Collective and the Center for Whale Research.

"We were surprised that, in many cases, the father was from the same pod as the mother. Based on earlier studies, we didn't think killer whales mated within their own pod," said Dr. Michael Ford, lead author of the study and a scientist with NOAA's Northwest Fisheries Science Center in Seattle.

"This behavior may be unique to the Southern Resident population, perhaps related to the population's small size," Ford added.

The researchers analyzed 78 individuals for 26 different genetic markers, or DNA fingerprints, and inferred the paternity for 15 mother-calf pairs. The study found no evidence that Southern Residents mate outside their population, but clear evidence that they do sometimes mate with members of their own pod.

"Even though some of the fathers were in the same pod as the mothers, none of them were really closely related to each other. Our results suggest that Southern Residents avoid mating with their siblings or parents, but we aren't really sure of the social process that results in this avoidance," Ford said.

Compared to many mammalian species, males within the Southern Resident community were also found to have a relatively low variance of reproductive success, meaning several males are responsible for offspring production in the population rather than just one or two. This contrasts with some other marine mammals like elephant seals, where a handful of males completely dominate the breeding and may reflect the difficulty male killer whales have in controlling other males' access to females.

However, the study also revealed that the older and larger males appeared to be responsible for most of the successful matings, indicating that females may choose to mate only with older males, or possibly that older males may prevent the younger males from breeding successfully.

Ford said he and his colleagues are particularly worried about the group's lack of genetic diversity, which he characterized as a "bottleneck." "Since this population remains isolated from other killer whale populations, mating within pods puts Southern Residents at risk of genetically deteriorating further from a potential increase in inbreeding or harmful mutations," he said.
